This website is owned and operated by One Up Offroad of Woodburn, Oregon, USA using platforms from a third-party provider. Our days of operation are Monday through Friday, 9:00am to 5:00pm PST.

Terms Clarification

“You”, “Customer”, “Your”, are the entities that are using our website, whether browsing or making a purchase. These terms and agreements are between that entity and One Up Offroad.

Copyright and Trademarks

All content on this website or any correspondence from One Up Offroad may not be downloaded, re-used, or redistributed without express permission of One Up Offroad. This includes any materials given to us from 3rd parties.

Permitted Use

The customer may use our website to browse our catalog, make purchases from our store, read any articles, and view any media posted. Any activity outside of the former statement breaks the permitted use clause.

Prohibited Use

  • You may NOT use our website to infringe on websites copyright, trademark, or other property by copying, selling, or transferring any data about oneupoffroad.com or ouostore.com, or any website operated by One Up Offroad.
  • You may not use this website to harass or threaten anyone.
  • You may not use our website for any illegal activity, such examples being fraud or misrepresenting your details.
  • You may not use the website to violate the rights of its other users.
  • You may not alter or modify the website’s intellectual property.
  • You may not violate or breach the website’s security and defense system, including the platform on which it is hosted.
  • You may not post anything inappropriate on reviews, such as adult or pornographic content, or anything threatening or harassing language.

Privacy

We adhere to strict privacy policies. Here you will find information regarding how we use and collect your data and any opt-out policies. We DO NOT sale or transfer your data to third parties, it is only used on the grounds of conducting business. Please view our Privacy Policy.

  • Communications
    • By placing an order or creating an account on our website, you agree that we can communicate with you via email or voice via phone regarding anything relating to your order. Should we offer newsletters/promotions, you will have to opt in. You can opt out via email request to sale@oneupoffroad.com at any time.
    • SMS Messaging
      • If you opt-in to use our SMS messaging services, you agree to receive texts regarding anything about your order. This is the most efficient way to communicate.
      • YOU MAY OPT-OUT by emailing use at orders@oneupoffroad.com -OR- sales@oneupoffroad.com.
      • We ARE NOT responsible for any standard Data/Messaging rates that may apply from your provider.

Liability

We are not responsible for any damage, expense, liability, loss, or personal injury due to your use of this website. This also includes instances in which our website has been hijacked for malicious intent.

Payment & Purchase Terms

Payment will be due when your order is ready for shipment. Based on the payment options at checkout, if a credit card was provided and it has been less than 14 days, One Up Offroad will run the payment card and ship the order. If has been more than 14 days or more, a payable invoice from Intuit Quickbooks will be sent to the email address provided. If a payable invoice option is selected, you WILL NOT immediately receive an invoice, nor do we guarantee it. You will generally receive an invoice once your order has been pulled from warehouse shelves and is ready to be shipped.

Usually this process is 1-3 days, UNLESS an item is on backorder in which case you will be contacted regarding this matter. The invoice will arrive with a payment link for the type of transaction invoice you selected upon checkout. It will come from Intuit QuickBooks via a One Up Offroad email address.

If you require another form of payment, such as cash or check, please contact us to arrange this. Keep in mind that this is not a statement of guarantee that these payment types will be offered. Essentially, it’s worth contacting us as we try our best to be flexible. Our products are not age restricted in their use, but the customer making the purchase should be of legal age to enter into a payment agreement and understand that we are not marketing to any persons under the age of 18.

We have the right to cancel any order for any purpose, especially if it is suspected of being fraudulent.

Returns Policy

No returns on items under $100.00 By the time you pay the shipping and invoice fee you will not get a return. One Up Offroad offers a 30-day return policy on selected items based on manufacturer return policies. One Up Offroad extends the return window to 90 days for One Up Offroad manufactured items over $100.

Please call 1-888-986-6987 or e-mail our Returns Department at sales@oneupoffroad.com to obtain a Return Merchandise Authorization (RMA) number before shipping your product. NO returns of any type will be accepted without an RMA number. For faster service, please have the following information on hand when calling for an RMA number: customer name, invoice number, serial number, and nature of the problem.

All products returned MUST be: 100 percent complete, contain ALL original internal boxes and packing materials, contain all manuals, and other accessories and documentation provided by One Up Offroad.

PRODUCT MUST BE RETURNED IN ALL ORIGINAL PACKAGING AND/OR IN A SIMILAR MANNER TO HOW IT WAS SHIPPED TO YOU TO PREVENT DAMAGE. If you return a product improperly packaged YOU WILL BE CHARGED FOR RECOATING THE PART AND RESTOCKING FEES, NO EXCEPTIONS. We spend time and money to ensure that your part arrives in perfect condition, if we are taking a part back we expect you to return it in the same condition it arrived in.

Returns Policy - Customer will be charged:

  • $50 Invoice / Credit Memo Labor. 
  • 10% of Jobber price - per item - for unopened new parts,
  • 20% of Jobber price - per item - for opened, new, unused parts,
  • 50% of Jobber price - per item - for opened, used, undamaged returns only on current design of items
  • no returns on discontinued items. 
  • no returns from Canada

 

  • Damage from improper use or installation is not warrantied.
  • Shipping charges to and from customers are not refundable.
  • OUO will never pay expedited shipping, even if we make a mistake.
  • All late Invoices will put you on COD.

              

You are responsible for shipping charges on returned items.

One Up Offroad strongly recommends you fully insure your return shipment in case it is lost or damaged and you use a carrier that can provide you with proof of delivery for your protection.

If merchandise arrives damaged: it is best to REFUSE it back to the carrier attempting delivery. If you accept the package, make sure it is noted on the carrier's delivery record in order for One Up Offroad to file a damage claim. Save the merchandise AND the original box and packing it arrived in, notify One Up Offroad immediately to arrange for a carrier inspection and a pickup of damaged merchandise. If you do not notify One Up Offroad of damaged goods within the first 15 days of arrival, our regular return policy will override any claim of damage and will fall under all current manufacturer restrictions. Call 1-888-986-6987 or your One Up Offroad account manager to arrange for a carrier inspection and a pick-up of damaged merchandise.

DEFECTIVE returns can be returned directly to One Up Offroad within 30 days from the invoice date, at One Up Offroad's discretion for: credit, replacement, exchange, or repair.

NON-DEFECTIVE returns can be accepted directly by One Up Offroad within 30 days from the invoice date, at One Up Offroad's discretion for: credit or exchange. See exchange terms below. All NON-DEFECTIVE returns are subject to a 30 percent restocking fee. Additional charges for any damage may also be charged. 

Due to manufacturers' policies, One Up Offroad cannot accept returns of the following items for exchange, replacement, or credit FOR ANY REASON: (One Up Offroad exceptions). DEFECTIVE merchandise can be returned for REPAIR ONLY to: One Up Offroad, the manufacturer direct or any authorized service center in your area. Additional manufacturers may be added to this list as: manufacturer policies change, manufacturer goes out of business or in the case of specially ordered items.

One Up Offroad reserves the right to authorize product returns beyond 30 days from the invoice date. If the product is accepted after 30 days, credit will be issued toward FUTURE PURCHASES ONLY. Shipping charges are NOT refundable except in the case of defective or damaged items or if the return is a result of our error. If the item is returned for any other reason, you are responsible for the return shipping costs.

Our return policy is standard to the industry, and it is our way of asking that you respect us in the same manner we respect our customers as we strive to have our products arrive at your doorstop in perfect condition.

Exchanges

One Up Offroad does not accept exchanges. If you need to exchange a part, it will be processed as a new order and a return of the original order. If you would like to use credit from the first order to the second order, the first order must be returned, received, and refund processed by One Up Offroad. That refund credit can then be applied to the new order.

Order Delivery Terms

We use UPS and USPS to deliver our packages. While we insure packages, we ARE NOT RESPONSIBLE for the loss of packages should a carrier lose or damage them. We package our products well to avoid damage from standard shipping practice, but unexpected situations arise. We are also not responsible for any theft of your packages when they leave our warehouse.

If tracking numbers are provided by your service selection, we will forward that information to you.

You may also arrange product pick-up at our warehouse if you require it. It must be picked up within our operating days and hours (M-F | 9am–5pm PST). Appointment times outside of operating hours may be available.

The same terms apply to any freight level of shipping.

Cancellations

You may cancel your order at any time. If we have received payment for the order, we will refund you. Refunds for ACH (Bank Transfer) payments will be issued in the form of a check, this may take up to, but not limited to, 2 weeks to process and mail. Refunds for credit cards will be issued to the original payment card. Please note a refund may not be immediately available due to banking terms/transfers. We do not offer cash refunds.

If an order has shipped and you cancel, you WILL be liable to pay for the return shipping. In many cases you may be able to refuse the shipment, but if that fails, you again will be liable to pay for return shipping. At this point, it is considered a return. Please review our return policy above for more information.

One Up Offroad also reserves the right to cancel any order as it sees necessary. Generally, cancellations occur from suspected fraud -OR- One Up Offroad was unable to reach the customer from any permitted forms of communication. One Up Offroad will attempt to send any pending cancellation notices for orders that have set for a length of time, generally after two weeks, UNLESS you have pre-arranged agreement with us. The excuse of not checking your “junk” email folder or ignoring any messages left are not valid.

If you cancel an order of a backordered product, you will lose your place in line. If you place another order for that same product, you will be moved to the end of the line as if you placed the order for the first time.

Website Disruption

As with most websites, upgrades and maintenance is required. There is always the possibility that our website will be under maintenance. We will usually post a notice at the top of our landing page informing the customer about any maintenance being performed. Generally, they are minimal and functionality for customer use typically remains intact.

Technology, being technology, can have outages. Outages may also be out of our control, as our platform is owned by a 3rd party and that provider may also be experiencing technical issues. Any outages are exactly that and we will work quickly as possible to restore full functionality of our website. We are not liable for any damage or issues this may cause. Cookies

Cookies are used to collect data and improve user experience. We do not sell this data and only use it to make our website more functional and understand customer interaction with our website via analytics. Examples of data collected include, but are not limited to, user experience, placing orders, remembering preference, etc.

Governing Laws

This agreement and all disputes arising out of or in connection with this Agreement shall be governed by and interpreted under, and construed and enforceable in accordance with, the laws of the State of Oregon, U.S.A, without giving effect to conflict of law principles.

Agreement

Any use of our website, whether browsing, ordering, or otherwise by any entity are bound by this agreement. You may not remove or cancel any clauses of this agreement. If you do not agree, then you may not be on nor purchase from our webstore.
